(AMM) Northeast Metal Traders' suit claims trademark violations

A Philadelphia scrap company is suing a Jersey City, N.J.-based competitor for allegedly infringing on its trademark and common law rights by using its name to attract customers.

Northeast Metal Traders Inc. filed the lawsuit against Northeast Iron & Metal Inc. in U.S. District Court for the Eastern District of Pennsylvania.

While the company names themselves are fairly easy to distinguish, newcomer Northeast Iron & Metal's Web address (http://northeastmetals.com) blurs identification. Northeast Metal Traders' Web address is www.metaltrader.com.

Northeast Metal contends that it has "continuously used the 'Northeast Metal Traders' mark in commerce in connection with its scrap metal services"...
